1. About This Policy

For the purposes of this policy, the relevant operator is EAK Ireland Tree Top Walks Limited in connection with the Treetop Walk and Viewing Tower operation at Avondale Forest Park.

2. Data Protection Principles

We process personal information in accordance with applicable Irish and European data protection legislation, including the General Data Protection Regulation (GDPR) and the Data Protection Act 2018. We aim to ensure that personal information is processed lawfully, fairly and transparently; collected for specified and legitimate purposes; limited to information reasonably necessary for those purposes; accurate and kept up to date where required; retained for no longer than reasonably necessary; and appropriately protected.

3. Information We May Collect

Depending on how you interact with us, we may collect information including name, postal or billing address, email address, telephone number, booking reference, ticket type, visit date and admission time, booking and purchasing history, gift voucher or annual-pass information, payment and transaction information, communication and marketing preferences, correspondence with our customer service or sales teams, group/school/corporate details where relevant, accessibility information you voluntarily provide, information required to investigate complaints/refunds/incidents/disputed transactions, website and booking-system usage information, and technical information such as IP address, browser/device information and cookies where applicable.

Payment card information may be processed through authorised payment service providers. We do not use full payment-card details for marketing purposes.

4. Why We Use Your Information

Booking and Contract Administration

We process information where necessary to perform our contract with you, including taking and confirming bookings, processing payments, issuing tickets, providing booking confirmations, managing amendments and cancellations, processing refunds where applicable, administering gift vouchers or passes, providing information necessary for your visit, and responding to booking-related customer service enquiries.

Legal basis: Performance of a contract or taking steps at your request before entering into a contract.

Operational and Customer Communications

We may contact you about matters directly connected with your booking or visit, including significant operational changes, changes to admission times, cancellation or closure, safety-related information, booking problems, or information reasonably required to deliver the service you purchased. These are service communications rather than marketing communications.

Legal basis: Performance of a contract and, where applicable, our legitimate interests in operating the attraction safely and effectively.

Legal, Financial and Security Requirements

We may process information where necessary to maintain financial and transaction records, comply with taxation and accounting requirements, prevent and investigate fraud, establish/exercise/defend legal claims, handle complaints and disputes, comply with lawful requests from public authorities, and protect our customers, employees and business.

Legal basis: Legal obligation and/or legitimate interests, depending on the circumstances.

5. Email Marketing to Existing Customers

When you provide your email address while purchasing a ticket or other service from Treetop Walk Avondale, we may, where legally permitted, use that address to send you information about our own similar products and services, such as Treetop Walk Avondale admission, returning-visitor offers, annual passes, Treetop Walk Avondale events, seasonal Treetop Walk experiences, ticket offers and other similar Treetop Walk Avondale visitor experiences.

For GDPR purposes, our legal basis for this processing is our legitimate interest in maintaining a relationship with existing customers and informing them about relevant similar Treetop Walk Avondale experiences and services. For electronic marketing, we will also comply with the applicable Irish electronic communications rules governing marketing to existing customers.

We will only use the existing-customer marketing exception where the applicable conditions are satisfied. This includes that the contact details were lawfully obtained in connection with a sale; the marketing concerns our own similar products or services; the customer was given an easy and free opportunity to object when the details were collected; the customer has not subsequently objected; and each marketing email gives an easy and free means of objecting to further marketing. The timing requirements under applicable Irish ePrivacy rules will also be observed.

You have an absolute right to object to the use of your personal information for direct marketing at any time. You may do so by unticking the marketing option during checkout, clicking the unsubscribe link in a marketing email, or contacting us. An unsubscribe from marketing will not prevent us from sending necessary communications concerning an existing booking.

6. Customers Who Have Not Completed a Purchase

The existing-customer marketing arrangements described above apply only where the applicable legal requirements are met. We will not treat a person who merely enters an email address or begins a booking without completing a qualifying purchase as an existing customer for this purpose. Where separate consent is required for marketing, we will seek that consent separately.

7. Other Marketing Consent

There may be circumstances in which we separately invite you to subscribe to a newsletter or other communication service. Where we rely on consent, you may withdraw that consent at any time. Consent-based communications will be clearly distinguished from communications sent under an existing-customer relationship.

8. Marketing Preferences and Profiling

We may use basic information about previous bookings to help ensure that communications sent to existing customers are relevant. Where such processing is used for direct marketing purposes, you have the right to object to it at any time. We will not make decisions producing legal or similarly significant effects about customers solely through marketing profiling.

9. Ticketsolve

Our online booking and ticketing system is provided using Ticketsolve. When you make a booking, relevant personal information may be processed through the Ticketsolve platform to create and manage your booking, issue tickets, maintain customer and transaction records, administer booking amendments, record communication preferences, support customer service and operate the online ticketing system.

Where Ticketsolve processes personal information on our behalf, appropriate data-processing arrangements will apply. Ticketsolve must not use customer information supplied through our account for its own unrelated marketing purposes merely because it provides the ticketing system.

10. Other Service Providers

We may use trusted third parties to provide services such as payment processing, website hosting, IT support, email distribution, analytics, customer communications, professional advice, fraud prevention and other technical or administrative services required to operate our business. Such organisations may process personal information only to the extent required for the relevant service and subject to appropriate contractual and data protection requirements.

We do not sell our customer database or provide customer information to unrelated companies so that those companies can market their own products or services to you unless you have separately agreed to this or another lawful basis clearly applies.

11. Sharing Information

We may disclose personal information where reasonably necessary to contracted processors and service providers, professional advisers, auditors, insurers, payment service providers, regulators, courts, law enforcement bodies or other public authorities where legally required. Where anonymised or aggregated information is used for analysis or reporting, we will seek to ensure that individuals cannot reasonably be identified.

12. International Data Transfers

Some technology or service providers may process information outside Ireland or the European Economic Area. Where personal information is transferred internationally, we will require an appropriate legal transfer mechanism and safeguards in accordance with applicable data protection law.

13. Retention of Personal Information

We retain personal information only for as long as reasonably required for the purpose for which it was collected and to meet applicable legal, accounting, contractual and operational requirements.

Booking and customer relationship information may be retained for a reasonable period following your last interaction with us in order to administer customer relationships, answer booking queries, deal with disputes or chargebacks, maintain transaction records, detect fraud and comply with applicable legal obligations. Financial records will be retained for the period required by applicable taxation, accounting and legal requirements.

Marketing information will not continue to be actively used where you have objected to direct marketing. We may retain limited suppression information so that your marketing preference can continue to be respected. Retention periods will be reviewed periodically.

14. Your Data Protection Rights

Subject to the conditions contained in applicable law, you may have the right to be informed about processing, obtain access to personal information we hold about you, correct inaccurate or incomplete information, request deletion in certain circumstances, request restriction of processing, receive certain information in a portable format, object to processing based on legitimate interests, object at any time to direct marketing, withdraw consent where processing is based on consent, and lodge a complaint with the Data Protection Commission. Some rights are subject to legal limitations and may not apply in every situation.

15. Your Right to Object to Direct Marketing

Your right to object to direct marketing is unconditional. If you tell us that you no longer wish to receive direct marketing from us, we will stop using your personal information for that purpose. Every promotional email sent by us will contain an unsubscribe facility.

16. Access, Correction and Other Requests

To exercise your data protection rights or ask a question concerning your information, please contact us using the details at the end of this policy. We may need to verify your identity before providing personal information or implementing certain requests.

17. Complaints

If you are concerned about how we have processed your information, we encourage you to contact us in the first instance so that we can investigate the matter. You also have the right to lodge a complaint with the Data Protection Commission of Ireland.

18. Security

We take appropriate organisational and technical measures designed to protect personal information against unauthorised access, accidental loss, misuse, alteration, disclosure and destruction. Access to customer information should be restricted to individuals and service providers who reasonably require it for their work.

19. Cookies and Similar Technologies

Our website and booking services may use cookies and similar technologies for purposes including enabling the website or booking system to function, remembering user selections, maintaining booking sessions, security, measuring website performance and usage, analytics, and advertising or marketing where permitted.

Cookies that are strictly necessary for the operation of the website or booking process may be used without optional consent where permitted by law. Non-essential analytics, advertising or tracking cookies will be handled in accordance with applicable cookie and electronic communications requirements. Where required, users will be provided with an appropriate cookie-management facility enabling them to accept or reject optional cookies.

20. Links to Other Websites

Our website or booking journey may contain links to third-party websites. Those organisations may operate their own privacy and cookie policies, and we encourage customers to review them. We are not responsible for how an independent third-party website processes information outside services controlled by us.

21. Changes to This Policy

We may update this Privacy Policy periodically to reflect changes to our services, booking systems, processing activities, service providers or applicable legal requirements. The current version will be made available through our website and booking system.
